Ferrobaires: los “gnocchi” de la mafia


Centenares de “trabajadores fantasma” son parte del  corrupto sistema de recaudación armado por las patotas sindicales en connivencia con altos funcionarios. Primera parte.

 


 

Por donde se presione salta pus en Ferrobaires. Ese es el estado de las cosas en la empresa estatal que administra los ferrocarriles de la provincia de Buenos Aires. El último episodio de una grave serie de irregularidades revela un sistema de corrupción mediante el cual sindicalistas de la Unión Ferroviaria (UF), en connivencia con funcionarios de la compañía, cometían un fraude laboral escandaloso. El delito consiste en el registro de centenares de “trabajadores fantasma” cuyos salarios son cobrados por entero por los ejecutores del plan, sin que los sujetos registrados sepan, siquiera, que figuran en el staff de la empresa. El armado de legajos, la inscripción de cuentas sueldo y la emisión de tarjetas de débito de estos “trabajadores fantasma” son la punta del ovillo de un método agravado de corrupción. La denuncia sobre el delito fue realizada ante la fiscalía de Lomas de Zamora. Los dardos apuntan contra Humberto Martínez, dirigente sindical de la UF, sin embargo, las denuncias judiciales son sólo un puntapié inicial para dilucidar un funcionamiento empresarial y sindical sólo equiparable con los imaginados por los autores de novelas sobre la mafia. La publicación de esta nota fue acelerada por las amenazas físicas que se cirnieron sobre las fuentes que otorgaron la información.

“En mayo de 2009 estaba terminando los análisis clínicos de mi nena que se iba a operar –cuenta Carlos Balduzzi, quien dejó asentada su imputación en la Fiscalía 15 de Lomas de Zamora y en el departamento Legal de Ferrobaires–. En el hospital me informaron que estaba afiliado a IOMA, algo que yo desconocía ya que trabajaba en negro. En ese momento recordé que le había dado mis documentos y datos a Humberto Martínez, que me había prometido trabajo en el ferrocarril. Fui a verlo y me dijo que, en realidad, todo se debía a una confusión ya que iba a empezar a trabajar a partir del día siguiente. Aunque resultaba sospechoso, empecé a concurrir a mi puesto de trabajo. Ante varios indicios, meses más tarde, fui a averiguar mi situación al banco y me enteré que los movimientos en mi cuenta sueldo se remitían a 2005. Fui a encarar a Martínez, que me dijo que no sabía nada. Cuando me puse más fuerte, me dijo que eso no dependía de él, sino de Guillermo Harvey y de Daniel Pearce, gerentes de Ferrobaires. Me dijo que iba a investigar y me transmitiría sus conclusiones. No lo hizo y por eso me presenté ante la Justicia”.

Otras denuncias engrosan el mismo expediente en esa fiscalía. Allí Laura Oyola dejó asentado que ingresó a trabajar al ferrocarril el 5 de abril de este año, convocada por Martínez. Según la denunciante, el sindicalista le pagaba por el trabajo de recepcionista la suma de 1500 pesos entregados en un sobre. Oyola concurrió a Recursos Humanos para pedir su recibo de sueldo, que le fue entregado y que tenía datos que ella no pudo reconocer. En el banco se enteró de que, en realidad, estaba registrada como trabajadora de Ferrobaires con un salario de 7800 pesos y que su cuenta sueldo tenía movimientos desde 2005.

También quedó registrada la denuncia de Jorge Cascales, que fue convocado a trabajar en Ferrobaires en 2009 por Martínez, a quien lo unía una relación amistosa. Sin embargo, alertado por los rumores, hace pocas semanas inquirió en el banco acerca de su estado y pudo anoticiarse sobre los movimientos en su cuenta sueldo, que se remitían al año 2005. En esa época, Cascales le había pasado sus datos y fotocopias de DNI a Martínez para que viera si le podía conseguir un empleo en el ferrocarril.

La registración fraudulenta de trabajadores fantasma requiere de la participación de funcionarios de jerarquía de la empresa que los documenten como empleados, les inicien legajos y tramiten las tarjetas de débito correspondientes. Las cuentas sueldo y las tarjetas de débito son emitidas por el Banco Provincia. Fuentes bancarias señalaron que la operación de apertura de cuentas se realiza sin que el banco deba estar al tanto de posibles maniobras fraudulentas. Varias personas ligadas a la empresa, del total de 1282 trabajadores contratados por Ferrobaires, un número cercano a la tercera parte está registrado de modo irregular.
“Trabajo desde los 18 años en el ferrocarril –cuenta el ferroviario Osvaldo Cruz, de 30 años–. Adentro sabemos quiénes están implicados en este sistema de corrupción, de los contratos truchos, de los ñoquis. Para poder ingresar al ferrocarril había que estar avalado por el gerente general de Ferrobaires y los departamentos de Recursos Humanos, Liquidación de Sueldos y los abogados. Toda la estructura se instaló en la época en que Alberto Trezza dirigía la empresa”. Trezza es un hombre del duhaldismo. Ferrobaires, en la actualidad, está intervenida por el ingeniero Antonio Maltana, técnico que en los noventa impulsó la privatización del ferrocarril y que fue designado por el gobernador Daniel Scioli luego de los choques de trenes de San Miguel.

Luciano Machuca, trabajador de Ferrobaires, denunció a plazademayo.com: “Acá hay una estructura mafiosa, como la de las películas. El interventor Maltana sabe de la corrupción, del grupo de choque patotero y no hace nada. Patoteros con denuncias judiciales incluso acusados como boqueteros cumplen funciones, como Héctor ‘Chuly’ Carruega, que era gerente de Atención al Cliente;  Norberto Saldaña, de Encomiendas o Daniel ‘Santa Fe’ Hess, de Ropería. Jorge Di Bono, uno de los gerentes que renunció, manejaba 35 tarjetas de débito. Mario Tate, de Área Operativa, 25 tarjetas. Carruega, 80 tarjetas. Daniel Pintor, jefe de Liquidación de Sueldos, 120 tarjetas. Sé todo esto porque fui testigo de cómo funcionaba el sistema”.

 

La situación cobró visos de violencia inusitada. Mario Tate, mencionado en la denuncia, fue hospitalizado el martes por la noche luego de ser atacado por una patota compuesta por siete individuos en el baño del primer piso de las oficinas de Ferrobaires en la estación Constitución. El violento episodio causó conmoción en el ferrocarril. “Héctor Carruega, que es de otro área de la empresa, quería que yo fuera a la intervención para que la gente suya trabajara en Mar del Plata –relató Tate a plazademayo.com–. Me negué. Entonces, con un grupo de siete guardaespaldas que lo acompaña, me atacó”.

–Hay denuncias sobre los trabajadores fantasma que lo involucran. Dicen que usted maneja 25 tarjetas de trabajadores que ni saben que trabajan en Ferrobaires. ¿Qué dice al respecto?

–No, yo no tengo nada que ver. Soy ferroviario desde hace 35 años. Escuché que circulan esas tarjetas. Es “vox populi”. Pero no tengo nada que ver.
Humberto Martínez, imputado por varias personas como una de las patas del plan delictivo, se reunió con este cronista en el estudio de su abogado, el doctor Carlos Broitman, que también defiende a Gustavo Juliá, implicado en el caso de la narcoavioneta, y que tiene un rol relevante en la causa de
Ciro James, entre otros casos. “No tengo constancia de esas denuncias –dijo Martínez–. Nunca escuché nada sobre tarjetas de débito adulteradas. Todas estas imputaciones se enmarcan en un ataque al sindicalismo. La Justicia se expedirá sobre el caso”. Martínez ocupa la primera línea del sindicato ferroviario luego de que José Pedraza y Juan Carlos “El Gallego” Fernández, los principales dirigentes de la Unión Ferroviaria, quedaran presos acusados como instigadores del asesinato de Mariano Ferreyra. Plazademayo.com intentó comunicarse con cada uno de los funcionarios de Ferrobaires mencionados en esta nota, pero no atendieron los llamados en sus internos de la empresa ni en sus celulares.

 

El ingeniero Maltana recibió a plazademayo.com en su oficina. “El atacante de Tate está apartado de su función, debido a una denuncia penal anterior. Es una situación muy triste, no vi nada igual en el ferrocarril”, opinó.

–Hay denuncias muy graves sobre trabajadores fantasma.

–El tema del personal es una prioridad para esta intervención. Ferrobaires tiene 1282 personas contratadas. Hay contratos de 16 años. Nos abocamos a relevar los listados para incorporarlos por tandas. Han aparecido denuncias a las que no hacemos oídos sordos, sino que nos ayudan. Tomamos la denuncia del señor Balduzzi. Apoyaremos a la justicia en esta investigación.

–El runruneo sobre irregularidades en la empresa existe. Mientras no encuentre pruebas concretas no podemos actuar. Nosotros estamos trabajando en este tema y actuaremos con precisión, fuerza y rapidez cuando tengamos cosas concretas
